The Federal Magistrates Court has confirmed that it considers “sending a message” important and that it will impose significant penalties for underpayments even if they are accidental. A Fair Work Australia Full Bench has created two sets of transition arrangements – one set for those classifications covered by the ASU’s Pay Equity application (Social and Community Employee and Crisis Accommodation Employee classifications) and another set for the Home Care and Family Day Care classifications.
